Termination of Rental Agreement upon foreclosure
Renters in good standing have been evicted from properties in foreclosures with little or no notice in violation of their leases. To address this problem, the Florida Legislature passed Florida Statute 83.561: Termination of Rental Agreement upon Foreclosure. This new law requires the purchaser of a Certificate of Title to give the tenants a 30 day notice. The aforementioned Florida law was created in order to fill the gap that was left when the Federal Protecting Tenants at Foreclosure Act expired on December 31, 2014.
